Your Main Exit Options Under NSW Law
The right path depends on your injury, how long you've been on the system, and your personal circumstances.
Here are the three main routes we explore with clients:
Option 1 — Lump Sum Payment, Permanent Impairment
If your injury has stabilised and is unlikely to further improve, you may be entitled to a lump sum payment under section 66 of the Workers Compensation Act 1987.
This lump sum compensation is separate from your weekly payments and does not automatically bring your workers compensation claim to an end. However, for many people, it can represent an important first step towards finalising their claim and transitioning off the workers compensation system.
The payment is intended to compensate you for permanent impairment resulting from your injury, based on assessed whole person impairment under the legislation.
Option 2 — Full Settlement, Work Injury Damages (Negligence-Based Claim)
If your employer was negligent and your injury has resultedin at least 15% whole person impairment (WPI), you may be able to pursue a workinjury damages claim.
A successful outcome typically means a larger lump sum, butalso means giving up ongoing weekly payments and most future medical expenses.This is often the clearest exit from the system, and one of the most commonmatters we handle for clients across Greater Sydney.
Option 3 — Commutation of Weekly Payments
In certain circumstances, it may be possible to convert yourongoing weekly payments and future medical expenses into a single lump sum, aprocess known as a commutation.
To qualify, you generally need to have been receiving weeklypayments for at least two years, have a permanent impairment of 15% or more,and have exhausted all return to work opportunities.
Both your insurer and employer must agree to thearrangement, and it must be certified by SIRA before any payment is made.Because a commutation permanently ends your entitlement to future payments andmedical expenses, it's a decision that requires careful consideration andindependent legal advice, both of which Gouveia Legal can provide.
